Trademark Registration

The protection of investors and their assets has become a priority for the Emirati Legislator. Therefore, several laws and amendments have been passed in regulating the registration of trademarks, which aim for the protection of the logo and the name of a company, as they are amongst the most significant assets of the company, which may not be used or imitated by others in an unauthorized manner. The law prohibits the registration of trademarks of a descriptive nature of the service or the product itself, or of public logos, flags, or the other symbols of international organizations, or any mark that is repugnant to public morals or that is in violation of the public order, or trademarks of a religious indication, or the geographical names whose use might result in causing confusion for an ordinary person in order to associate the proposed trademark with some origin-based geographic indicators. If your trademark is registered, it is granted protection as from the date of submission into the special register of trademarks.

Arbitration

Arbitration is a means regulated by the law, by which a dispute between two or more parties is adjudicated by virtue of a binding award by the arbitration panel “the arbitrators” based on the agreement between the parties on forwarding the dispute to a local or international arbitration entity, authority, or center for the adjudication of the said dispute by the issuance of a binding and enforceable arbitration award, instead of the adjudication of the dispute by the judiciary. The agreement of the parties on arbitration shall be in the form of an arbitration clause that is stated in a contract, or in the form of an independent arbitration agreement that is made after the arising of the dispute.
